Legal Status of the State of Hawaii within the U.S.?

Guy's, first am not taking a snipe at Mr Obama, second I have no axe to grind at all, just curious about this fact. A man was saying last week that Hawaii is not Constitutionally Legal as a State of the Union because it was taken by Military Occupation. I understand some Americans dispute West Virginia's status within the Union. Is the status of Hawaii and West Virginia questionable within the Union? or are some folks just using clever words to bamboozle us all.
